Memorand[um] [tha]t before the statutes 21o H:3: ca:10: 18o E:7: ca:10/4o H:4: ca:18: there was not in the Courts of Westm[inste]r any Attorneyes at all without speciall licence from the King, and in the Court of the Excheq[ue]r. w[hi]ch is the venture of the Kings revenue and profitt so great care was taken that no man might sue or plead for their dischardge of any debt Accompt or other demand without haveing expresse Commandm[en]t by writt or l[ett]re vnd[e]r the great Seale and no plea could bee to allowed in the Excheq[ue]r but in proper p[er]son; but by the stat[ute] 5o K:2: Cappe[n]t was altered as followeth Item because [tha]t grevious complaint hath oftentimes beene made of the officers of the Excheq[ue]r for that the heires Execut[ors] occupiers of goods and lands tenem[en]ts of diverse persons w[hi]ch haue beene impeached in the said Excheq[ue]r of Debts Accompts and other demands and w[hi]ch although they haue offered them there to shewe or pleade for their dischardge of those impeachm[en]ts according to the lawe. Itt is ordered and assented that the Barons of the said Excheq[ue]r shall from henceforth haue full power to heare every answeare of every demand made in the said Excheq[ue]r. So that eu[er]y p[er]son that is impeached or impeachable of any Cause by himselfe or by any person shalbe from henceforth receiued in the same Excheq[ue]r to plead sue and haue his reasonable dischardge. Item for sundrie damages and mischances that haue ensued before this tyme to diverse persons of the Realme by a great number of Attorneyes ignorant and vnlearned in the lawe as they were wont to bee before this tyme &c. Itt is provided ordained and established that all the Attorneyes shall bee Examined, by the Iustices and by their discretions their names putt in the Roll &c. And that this ordinance be holden in the Excheq[ue]r after the discretion of the Treas[ur]e and Barons there. T: F: by l[ett]res patents is consti[n]teed and appointed. R[ec]e[m]mem[oriam] R[ec]e[m]ps: with words to make or sweare Clerkes or Attorneyes But p[re]scribes that tyme out of minde hee and his Predecesso[u]rs Remem[oriam] haue sworne Clerkes in his office and give this oath following (vizt) Yf hee shall truely and diligently behaue y[ou]rselfe as a Clerke in this office vnd[e]r the M[aste]r of the same for the tyme being in all that to you as a Clerke in the same office doth appertaine yee shall not race nor imbezell, ne assent nor consent to the raceing or imbezelling of any proces or Records of this Court nor of any writt nor retorne of writt nor of any m[an]u[m]d[en]t or p[er]cept of this Courte direct or to be direct to the pl[ain]tice of the King or any other p[er]son And if yee shall hereafter knowe any thinge done or ymagined to the hurt of the M[aste]r of this said office for the tyme being yee shall doe him notice thereof with all Convenient speed and occupie y[ou]rselfe for the furtherance of the businesse concerning this office w[ha]t according to such power and knowledge as god shall give you. So helpe you God at the holy Roome, and by the booke hee p[re]scribes that a Clerke so sworne hath his place for life with an Annuall Fee from the Crowne and is not removeable by a succeeding Remembranc[e] being officers for the busines of that office and being Clerkes for the King they practice as Attornies for the Subiects in dischardge of the Kings debts duetyes and Revenue vpon Record.
